Read the general pathway comparison overview
Existing status changes the procedural questions, not the underlying eligibility tests. L-1 still needs a qualifying transfer and E-2 still needs a qualifying treaty investment. Review admission records, work authorization and travel plans before comparing a domestic status request with consular processing or assuming that approval of status produces a travel visa. A first review should identify the route’s earliest documentary gate and then list the procedure separately. For L-1, inspect the qualifying relationship and the beneficiary’s continuous qualifying foreign employment for one year in the three years before filing; L-1A has a generally seven-year maximum and L-1B a generally five-year maximum. For E-2, examine treaty nationality, enterprise ownership, capital irrevocably committed and exposed to loss, non-marginality, and the investor’s role directing the business.
Build an accurate status chronology
Collect I-94 records, approval notices, visas, work documents and travel history for each family member. Identify authorized activity and expiry dates. A visa stamp and a period of authorized stay are different facts. Counsel should assess the proposed procedure using the actual record rather than assuming that physical presence in the United States makes every category change available. Make the chronology from primary records and flag every departure or status change that affects the procedure. Hypothetical example: an acoustic materials testing firm considering a transfer should compare payroll dates with travel records before assuming that the foreign employment year is easy to prove.
Keep eligibility and procedure in separate columns
Document the L-1 corporate and employment requirements alongside the E-2 nationality and investment requirements. Then ask which filing or visa steps are available under the person’s circumstances. A domestic change-of-status approval is not itself a travel visa. Nationality and intended travel may affect procedure, but procedural convenience cannot replace a missing substantive requirement. Use two evidence columns, one for each route, and ask which required record exists now. A domestic approval affecting status is different from a visa used for travel. The concrete choice is whether procedural convenience is worth pursuing when the substantive documents favor the other route.
Review work and travel before action
Neither an investor commitment nor a pending category request automatically authorizes new work. Identify the activities the founder and spouse intend to perform and obtain advice on the relevant permission. Discuss travel before relying on an application strategy it could affect. Keep family status deadlines independent from the expected progress of the principal’s case. List planned work and travel by person, then seek advice before anyone changes activities. A pending request or investment commitment does not independently authorize new work. Family status dates should be tracked on their own, because the principal’s hoped-for timing may not control them.
