Read the general investor planning overview
Future wages belong in a credible operating plan, but a hiring forecast is not the same as capital already invested. Separate employment projections from actual payments and commitments. E-2 does not impose EB-5’s ten-job requirement, so adding salaries to reach an invented hiring or spending target is the wrong calculation. A first review should create two columns: money already committed to the enterprise and future operating expenses that remain projections. Source documents, transfer records, contracts, and receipts settle the first column; a grounded business plan explains the second. E-2 capital must be irrevocably committed and exposed to commercial loss, while the enterprise must be more than marginal. A prospective payroll total cannot replace either analysis.
Distinguish planned and paid amounts
Show payroll already incurred separately from expected future staffing costs. Match actual payments to business records and explain how the enterprise is funded. Do not add several years of projected wages to a present investment total as though that money has already been spent. Counsel should review the capital schedule while the business plan explains future obligations. Give each item a date, payee, purpose, and record, then mark whether the investor can still retrieve it freely. Hypothetical example: a bicycle frame refinishing shop that pays for ventilation equipment and a signed premises fit-out should retain invoices and the contract rather than count a later staffing budget as present capital.
Support why the roles are needed
Connect each proposed hire to customers, services, hours and revenue assumptions. A credible staffing plan can support the enterprise’s economic capacity, but an unsupported list of employees is weak evidence. Avoid treating family members’ hoped-for work as a shortcut around realistic operational planning. Immigration status and authorization for each worker remain separate from the financial forecast. For each future role, identify the customer demand, operating bottleneck, and funding month that make it necessary. This exposes whether a plan depends on revenue that has not yet been earned. The decision is whether a proposed role belongs in a conservative launch plan or only in a later growth scenario.
Evaluate non-marginality independently
The enterprise’s required economic capacity is not determined by an invented universal headcount. Review available revenue evidence and grounded projections alongside staffing needs. A business may spend substantial money yet still have an inadequate operating plan. Preserve the distinction between qualifying committed capital and evidence that the enterprise can develop beyond merely supporting the investor’s minimal living. Review economic capacity separately from the capital schedule. Hiring may support a credible growth account, but it does not impose an EB-5-style numerical target. The investor must also be able to develop and direct the real enterprise described in the records.
