Do we need a paid salary survey to prove advanced knowledge?

THE DIRECT ANSWER

There is no universal requirement for a paid salary survey, and compensation does not by itself establish specialised knowledge. Begin with direct evidence of capabilities, training and assignments.

Spend on the actual gap

If salary information is relevant, explain its limits and any differences in roles or compensation arrangements. Do not purchase a broad market report merely to replace missing internal evidence. Budget any useful comparison work separately from government filing fees, applicable supplements, optional premium processing and dependent costs.

L-1B does not require a labour-market recruitment exercise. Spend on the gap the file actually has, which is usually internal and cheap to close. A paid market report is not required and compensation does not by itself establish the knowledge claim, so a broad purchase made to fill a documentary hole tends to produce an expensive exhibit answering a question nobody asked.

Start with direct evidence of capabilities, training and assignments, and where salary information is genuinely relevant, explain its limits and any differences in roles or compensation arrangements. Budget any comparison work separately from government filing fees, applicable supplements, optional premium processing and dependent costs. Ask what each proposed purchase would prove before it is commissioned.

This classification does not require a labour-market recruitment exercise.
