IN THIS GUIDE · Preparing for removal of residence conditions
Start with the EB-5 eligibility and application overview
Know which event starts the calendar
The removal-of-conditions schedule relates to the grant of conditional permanent residence, not the date money was wired or the investor petition was filed. USCIS describes an I-829 filing window within the 90 days before the second anniversary of that residence grant. Record the actual admission or adjustment date and have counsel establish the correct deadline for the case. Put the residence-grant date, filing-window calculation, and responsible person in one controlled calendar. The record that settles the starting point is the admission or adjustment evidence, not a project newsletter or wire confirmation. If family members obtained residence on different dates, flag that immediately so counsel can determine the correct individual steps rather than working from a household estimate.
Preserve the investment history
Keep enterprise accounts, capital receipt and deployment records, relevant financial reports and material changes. The applicable investment-sustainment analysis depends on the governing rules and filing circumstances. Do not translate a conditional-residence period into a guaranteed repayment date. Ask counsel what must be established for this investor and the enterprise, and ask the project which documents it will provide. Ask the enterprise for a document-retention schedule before relying on any projection. It should identify the capital account, deployment records, financial statements, material amendments, and the person authorised to release them. This produces a clear decision: whether the investor has a dependable evidence path or needs contractual access and reporting commitments before proceeding.
Connect jobs to actual evidence
The later filing must address qualifying job creation under the relevant standards, not simply repeat an early forecast. Collect the payroll or methodology-specific expenditure and activity records needed for the case. Distinguish completed outcomes from expectations that still need evaluation. If performance changes, seek advice promptly about its effect rather than assuming a report bearing the original project name is sufficient. Match each asserted job to the appropriate underlying record and date, then distinguish a completed position from a forecast. Payroll, tax records, expenditure records, and the governing economic methodology may answer different questions. A project’s early job model is useful context, but it does not settle whether the investor can later satisfy the applicable job-creation requirement.
Coordinate family records
Maintain each family member’s residence date and status documents, especially where the family did not all become residents together. Counsel should determine who is included in a petition and whether different filing steps are needed. Changes in family circumstances deserve review before the deadline. Keep current contact and representation information so notices and requests reach the people responsible for responding. Family planning should include residence documents, marital changes, births, and contact details alongside the investment record. The applicant should decide in advance who will monitor notices and preserve copies if the project manager changes. Conditional residence does not remove the need for an individual filing strategy, and a changed household should be reviewed before a deadline forces a rushed response.
