Should spouse work plans decide between L-1 and E-2?

THE SHORT ANSWER

Qualifying spouses in valid L-2S or ordinary E-2S status generally have employment authorization incident to status. That similarity does not make the principal routes interchangeable. Choose the principal category from its supported requirements, then plan each family member’s actual admission or status documentation rather than assuming filing alone permits work. The first review should produce a route comparison that identifies the decisive record for each option: corporate relationship and foreign employment for L-1; treaty nationality, source and commitment of funds, enterprise operation, and investor control for E-2. L-1 requires a qualifying year abroad during the three-year period before filing and has seven-year L-1A and five-year L-1B ceilings. E-2 capital must be committed irrevocably and put at risk, while the enterprise must be real and not marginal.

01

Establish the principal’s eligibility first

For L-1, review the transfer relationship, foreign employment and U.S. role. For E-2, review treaty nationality, qualifying investment and direction. A spouse’s job offer cannot replace a missing principal requirement. Compare these substantive facts before focusing on family work preferences, because derivative status depends on the qualifying principal arrangement and the family’s own procedural requirements. Hypothetical example: an aquaculture-genetics company has an investor with treaty nationality and funds ready to deploy, but its proposed U.S. manager has spent only eight months on the foreign payroll. Bank records and corporate registers may support an E-2 review; the payroll chronology prevents an L-1 decision from being assumed. The concrete choice is whether to pursue the investment route, wait until a qualifying employment history exists, or assign a different person.

02

Check the spouse’s actual evidence

The spouse needs valid qualifying status and appropriate evidence, commonly the relevant spouse-designated I-94. A principal’s approval notice or pending application does not itself establish the spouse’s work authorization. Review admission, extension and travel plans separately. The spouse’s nationality need not simply be assumed to match the principal’s, and the applicable family process should be assessed for the real circumstances. Start with records that can end a route quickly. For L-1, obtain the dated organization chart, ownership evidence, and foreign employment history before commissioning elaborate operating projections. For E-2, trace funds from lawful source through transfer and commitment, then test whether the investor will direct the business. This sequence prevents a well-written plan from consuming time before a threshold fact is known.

03

Plan children separately

Qualifying unmarried children under 21 may seek the relevant dependent classification, but dependent children do not receive work authorization merely through L-2 or E-2 status. Track age and individual status dates rather than treating the household as one document. Schooling and the spouse’s employment plans should reflect actual granted status, not an expected approval date or a project’s promised schedule. Keep family work preferences in a separate column until the principal route is selected. Eligible spouses in valid L-2S or ordinary E-2S status generally have employment authorization incident to status, but a job offer does not establish the principal case. The decision record should state each dependent’s intended timing and supporting evidence, because a household plan can fail even when the business route is viable.
