The forecast should reflect the actual intended staffing and household arrangements, not artificial assumptions selected to improve the application. Potential spouse earnings elsewhere do not replace the enterprise’s non-marginality evidence.
Describe family work honestly
A spouse in valid E-2 or E-2S status generally has work authorization incident to status, but the principal still needs to develop and direct the business. Dependent children under 21 do not receive work authorization through that status. If the recovery depends on family members working, identify their real roles, costs and authorization needs rather than hiding labour requirements behind assumed unpaid help.
State the family labour plan as it really is. Where a recovery depends on a spouse covering reception, scheduling or deliveries, that is a staffing requirement with a cost and an authorization question, and describing it as help conceals both. A spouse in valid E-2 or E-2S status generally has work authorization incident to status; dependent children under 21 do not receive work authorization through that status.
Build the forecast on the staffing actually intended, at realistic cost, rather than on assumptions chosen to improve the projection. The principal must still develop and direct the business, and potential spouse earnings elsewhere do not substitute for the non-marginality evidence.
