Can the family home be counted as the business premises?

THE DIRECT ANSWER

A residence and commercial premises serve different purposes. If a business genuinely uses part of a home, document that use and the applicable arrangements; do not count the family’s entire housing cost automatically as investment.

Keep personal relocation separate

The enterprise must meet its own operating and investment requirements. Family members also need appropriate dependent documentation: spouses and unmarried children under 21 may qualify. A spouse in valid E-2 or E-2S status generally has work authorization incident to status, while children do not.

Home ownership or occupancy does not create immigration permission or establish that the proposed business activity is permitted there. Use separate agreements, separate payment records and separate files for the residence and the business premises. If part of a home is genuinely used by the enterprise, define the area, the arrangement and the amount attributable to it, and have that treatment reviewed rather than assumed.

The boundary matters for people as well as space. A spouse in valid E-2 or E-2S status generally has employment authorization incident to status; children do not. If a family member helps in the business, decide what that participation is before it starts, and never let a household routine become the enterprise’s staffing answer.

Relocation costs, school fees and household purchases belong in the family budget. Keeping them out of the investment record makes the investment record easier to defend.
