Start with the GOLD CARD eligibility and application overview

01

Establish who monitors the case

Identify the applicant and any authorised representative responsible for reading official messages. Agree how notices will be shared and who can act. A family assistant or company coordinator can help organise a log, but their role should not be confused with legal representation or government authority.

02

Follow the account instructions

The official FAQ says USCIS will instruct applicants to create a my.USCIS.gov account and provide the next documentation steps. Use verified instructions associated with the case. Do not create assumptions about account access or hand credentials to someone merely because they offer to accelerate the process.

03

Keep a response trail

Save notices, uploaded documents and submission confirmations with dates and version labels. Record the specific question a response addresses. This helps counsel check consistency if additional information is requested and avoids uncertainty over whether a draft was actually submitted or simply circulated for review.

04

Escalate unexpected messages

Verify an unusual payment request or a major change in instructions through a trusted official or authorised channel. Preserve the message for review. Do not interpret silence after an upload as acceptance, and do not let a third party’s informal progress report replace the actual agency record.

05

Decide who may act and who may only assist

Two roles are commonly merged in a family’s case file and should not be. A representative acts: they may be recognised in the process and may take steps on the applicant’s behalf. An assistant organises: they maintain the log, chase documents and prepare drafts. Both are useful. Only one carries authority, and the distinction belongs in writing before any account is opened. Hypothetical example: a founder of a packaging automation business asks a company executive assistant to monitor correspondence during a busy commissioning period. That arrangement can work if the assistant’s role is confined to flagging and filing, and if the applicant reviews and approves every response. As currently described, the programme requires a nonrefundable DHS processing fee and, after vetting, an unrestricted gift to the United States that is deposited in the Treasury; successful applicants proceed through EB-1 or EB-2 subject to eligibility, admissibility and visa availability. Obtain the current written procedure rather than acting on a summary. Never share account credentials with an assistant as a shortcut.

06

Keep the payer, the applicant and the adviser distinct

Where funds move, three questions arise immediately: who pays, on whose behalf, and from what source. Answer them in writing at the start. A company may offer to handle a payment for a founder, or a relative may offer to fund it, and either arrangement may raise questions that are easier to address before the money moves than afterwards. The individual Gold Card framework requires the applicant to pay a nonrefundable DHS processing fee and, after vetting, make an unrestricted gift to the United States that is deposited in the Treasury. It is not an investment in an enterprise, and it should not be analysed as though EB-5’s at-risk capital and job-creation requirements applied to it. Hold those two conversations in separate files, with separate advisers where that is what the facts call for. Confirm that whoever gives the immigration advice is not also the party arranging or receiving the payment, and where one firm does both, ask in writing how the conflict is managed and who reviews it. Programme terms may change; obtain the current official procedure before relying on any description of them, including this one.
