Can a software employee’s L-2 spouse take a remote job?

THE DIRECT ANSWER

An eligible spouse in valid L-2 status is employment authorised incident to status, with appropriate documentation such as an unexpired L-2S I-94. The spouse’s permission comes from that status, not from the principal working in software or remotely.

Check status before starting

Verify the spouse’s admission and employment evidence, and obtain separate advice on tax or employment arrangements where needed. Eligible unmarried children under 21 can hold L-2 but cannot work through it. The principal remains limited to qualifying authorised L-1 employment; the spouse’s broader work permission does not expand the principal’s permitted assignments.

The failure mode is a spouse starting work on the strength of the principal approval rather than their own status evidence. An employer verification process examines what the spouse presents, and a principal petition is not among the documents it can consider. The earliest signal is an onboarding conversation in which the company asks for the principal paperwork.

Verify the spouse own admission and employment evidence before a start date is agreed, and obtain separate advice on tax or employment arrangements where a remote role crosses borders. Eligible unmarried children under 21 can hold L-2 but cannot work through it. The principal remains limited to qualifying authorised L-1 employment, which the spouse broader permission does not widen.
