When is the training record ready for filing?

THE DIRECT ANSWER

The file should show that the employee already meets the requirements when the petition is filed. A promise to acquire essential knowledge after reaching the United States is not evidence that the employee currently possesses it.

Set an evidence milestone

Ask the technical manager to confirm which capabilities are demonstrated and which remain in development. Resolve missing assessments and employment-date conflicts before choosing a filing date. Processing and any visa or admission steps come after preparation; a project deadline or completed course does not guarantee an immigration decision by a particular date.

Fix the moment at which the record is frozen. Knowledge cases tend to keep improving — another assignment finishes, another assessment is signed — and a file that is continually revised is a file that is never submitted. Choose a date, take the evidence as it stands, and note genuinely material developments separately.

Watch for the reverse problem too: if the U.S. project the transfer was built around is redefined, the mapping between established knowledge and proposed duties may no longer hold, and that is a reason to revisit the case rather than to file the earlier version. The employee should meet the requirements at the time of filing, so a capability scheduled to be acquired after arrival belongs in the plan for the assignment rather than in the argument for eligibility.
