Should a startup rely on a spouse working after the move?

THE DIRECT ANSWER

An E-2 spouse in valid E-2 or E-2S status is generally employment authorized incident to status, but hoped-for spouse earnings should not replace the startup’s own non-marginality evidence or its operating budget.

Separate the household plan from the enterprise

A spouse and unmarried children under 21 may seek dependent status; children do not receive work authorization through that status. Budget household needs independently while preparing relationship and travel records. Before a spouse starts employment, check the admission documentation and acceptable employment-verification evidence.

The startup forecast should still show a credible business on its own commercial assumptions. Build the household budget on the assumption that the enterprise produces nothing for a defined period, then check whether the plan survives it. A startup’s early cash is committed to the business precisely when a family’s relocation costs are highest, and a founder who has to draw from the venture to cover household expenses may weaken the case the investment was intended to support.

Keep the two accounts and the two sets of records separate from the outset. Where a spouse expects to work, treat that income as a possibility to be confirmed rather than a line in the forecast, and confirm the documentation each employer will require before employment begins. Children may accompany as dependants while unmarried and under 21, but that status does not itself carry work authorization.
