Your talent.A bigger stage.

TN planning starts with three connected questions: what work is proposed, whether the applicant meets the profession’s requirements, and how the person would seek authorization. This broad overview helps a first conversation produce useful next steps. It also brings family needs, costs, and timing into the discussion before a relocation plan becomes fixed. Most TN problems that surface later began as an untested assumption at this stage: an unexamined job title, a credential nobody compared against the appendix, or a start date promised before anyone knew which route applied. Naming those assumptions in the first conversation costs an hour; discovering them at a port of entry can cost the trip and, sometimes, the position itself.

IN THIS GUIDE · First-conversation TN triage across the role, qualifications, and application route

01

Describe the work before choosing a category

Start with a plain-language account of the proposed responsibilities, the employer or receiving entity, and the expected duration. TN is available only for qualifying Canadian or Mexican citizens undertaking prearranged professional activity within a listed profession. A familiar job title alone does not establish the match. Ask the manager to describe the work that will actually be performed, including mixed responsibilities, supervision, and the project’s purpose. Keep the temporary nature of the proposed stay visible.

02

Compare credentials with the specific profession

Gather the applicant’s education, professional credentials, and relevant experience, then compare them with the requirements of the profession being considered. Do not apply a universal degree-equivalence formula or assume years of employment replace a required degree. Identify any translation, evaluation, or licensing issue for review. The first conversation should end with a clear distinction between evidence already available, facts needing clarification, and a qualification gap that may make TN unsuitable for the proposed role.

03

Choose the route using personal circumstances

Nationality, physical location, current U.S. status, and prior immigration history affect the route discussion. Canadian citizens generally may seek TN admission without first obtaining a visa; Mexican citizens generally need a TN visa for admission. An employer petition may be an option in appropriate Canadian cases. These are starting distinctions, not a route recommendation for every applicant. Review the actual circumstances before filing, travelling, or assuming that an approval notice alone permits work to begin.

04

Turn the assessment into decisions

Ask the reviewer to identify the strongest eligibility questions, the documents needed to resolve them, and the employer’s next task. Include any family members who would travel and whether the household depends on their employment. In a hypothetical first consultation, the useful result may be a request for a fuller duty statement rather than a completed application. Agree on a follow-up milestone and keep travel, resignation, and housing decisions aligned with the uncertainties still outstanding.

05

Four assumptions that collapse under questioning

Four recurring errors account for most avoidable TN trouble, and each is cheap to catch early. The first is matching a job to a profession by its title, which hides duties that fall outside the listed professional activity. The second is describing an arrangement as employment when the applicant would in substance be working for a company they own or control, because TN does not permit self-employment. The third is treating a document — an offer letter, a credential evaluation, an approval notice — as authorization in itself, when authorization follows from the applicable admission or petition outcome. The fourth is folding a spouse’s intended job into the principal’s plan, since TD status permits study but not employment. Unwinding any of these after travel, resignation or a signed lease is far more expensive than raising it now.

06

Recovering when the duties do not match

Mismatches are usually discovered late because nobody read the duty statement against the appendix while the offer was still negotiable. Hypothetical example: A management consultant accepts a U.S. role whose written duties turn out to be largely operational supervision of a small team rather than advisory work. Three options remain, none of them quick — renegotiate the duties with the employer, establish qualification under a different listed profession if the work genuinely fits one, or postpone the move. The appendix does allow equivalent professional experience for management consultants, established by a statement or professional credential attesting to five years’ experience as a management consultant or five years’ experience in a field related to the consulting agreement, so a degree gap need not end the discussion, but that experience has to be documented rather than asserted. Deciding who rewrites the duty statement, and by when, determines whether the file recovers or starts again.
