The case must establish a qualifying business relationship, the required continuous qualifying year of employment abroad, specialised knowledge and a U.S. position involving that knowledge. The employee may possess special knowledge, advanced knowledge or both.
Start with facts and the correct route
Knowledge need not be proprietary or unique, but it must be supported and meaningfully distinguished from ordinary knowledge. New-office and primary client-site cases have additional considerations. Blanket L-1B requires a specialised knowledge professional.
Nationality can affect visa and admission procedures, but residence in Toronto does not create separate eligibility rules. Eligibility is tested against the facts as they stand when the case is decided, not as they stood when drafting began. Hypothetical example: A payments processing group prepares a transfer, then merges the employee’s division into a newly incorporated subsidiary shortly before filing.
Three elements need rechecking at once: whether the qualifying relationship between the U.S. and foreign employers still exists in the new structure, whether the employee’s continuous qualifying year abroad remains attributable to a qualifying organisation, and whether the specialised knowledge described still relates to the work the reorganised business performs. Diarise a short re-verification immediately before submission covering entity names, employment continuity, duties and worksite.
Where a fact has moved, amend the description rather than leaving a statement that was accurate only when written.
