When should I respond to notice of a project change?

THE DIRECT ANSWER

Obtain the documents and advice promptly, especially if consent or a government response has a deadline. Waiting until removal of conditions can make it harder to explain a change or recover supporting records.

Distinguish response deadlines from predictions

Record the contractual date and ask counsel whether there are separate immigration deadlines or actions. Confirm whether the change is proposed or completed before deciding what evidence is needed. Keep a dated record of requests and responses.

A project’s revised completion forecast does not determine adjudication, visa availability or the family’s actual residence date. Diarise two separate clocks, because they do not run together. One is contractual: consent windows, subscription terms and notice periods, all of which pass whether or not you have advice.

The other is procedural: the stage the case has reached and any action the government has requested. Hypothetical example: a hearing-aid retail chain project sets a short consent deadline over a holiday period, and an investor who waits to gather advice loses the option to object while retaining every consequence of the amendment. Enter the contractual date the day the notice arrives, then ask counsel whether a separate immigration step follows.

Record when each request was made and answered. A revised completion forecast is the project’s own estimate and settles nothing about adjudication or visa availability.
