Can I rely on today’s threshold for a later filing?

THE DIRECT ANSWER

Do not assume a threshold remains unchanged throughout a long planning period. The applicable filing rules and scheduled statutory adjustments must be checked before the investment and petition strategy are finalized.

Record a recheck milestone

Keep the original project and category evidence, then ask counsel to confirm the amount relevant to the intended filing. A subscription deadline cannot freeze immigration law merely by using a current price. Review funding and fee budgets again if the schedule changes.

Any category-related processing policy also remains separate from visa availability and cannot establish a guaranteed date for family residence. Diarise the recheck and name the person who owns it. Long projects change hands, staff move, and whoever explained the structure at the outset may not be there when the petition is prepared.

A named owner on your side keeps the question alive. Hypothetical example: a warehouse robotics facility changes its general contractor and its opening slips by two seasons. The project’s own documents move; your file only follows if someone is responsible for asking.

At the recheck, establish whether the applicable requirements have changed, whether the project’s facts still match its documents, and whether your own circumstances have moved. Keep the project’s schedule and your family’s schedule on separate lines, since each runs to its own clock.
