What documents support a reduced-threshold claim?

THE DIRECT ANSWER

The evidence depends on the category. Area-based claims need the relevant project-location and designation support; an infrastructure claim needs documents establishing that the project meets its separate legal definition.

Demand a project-specific explanation

Ask counsel to connect the supporting materials to the actual enterprise and investment described in the petition. Compare the project address and activity across the offering, business plan and legal analysis. Keep the version reviewed for the filing.

A brochure’s rural or infrastructure label, or another investor’s unrelated approval, is not a substitute for evidence applicable to this project and filing. Ask for each document from the party responsible for its accuracy, and note that party in your file. An economist’s report should come with the economist named.

A location analysis should identify who prepared it and on what data. A summary written by a sales team is a summary, and it is the wrong record to lean on when a question arrives years later. Compare the project address as it appears in the subscription agreement, the business plan, the economic analysis and any government correspondence.

Differences are usually clerical and occasionally material; you cannot tell which without checking. Retain the exact versions reviewed for your filing, dated, alongside a note of what your counsel examined. Later editions of the same document may say something different.
