Use the ownership ledger, operating or shareholder agreement, voting provisions, management contracts and board records where relevant. These should support the decision-making authority described in the application.
Check for contradictions
A management title may coexist with removal rights or reserved decisions held by other owners. Identify those limits rather than supplying only the document that appears favourable. Trace entity ownership to individuals for the nationality analysis, and show the applicant’s invested capital separately.
Evidence of substantial spending cannot replace proof that the applicant will develop and direct the enterprise. Collect the records capable of contradicting the application before a reviewer does. The ownership ledger, the operating or shareholder agreement with all amendments, voting provisions, management contracts and relevant board minutes together show whether stated authority exists in practice.
Minutes are particularly useful because they record who actually decided recent material matters, and a pattern of decisions taken by others is difficult to reconcile with a claim of direction. Where a limit exists, include it and explain it rather than omitting the document containing it, since a file presenting only favourable extracts leaves the unfavourable clause to be found later in a worse setting. Prepare a short index mapping each control assertion in the application to the document and clause supporting it, so the evidence can be checked without reading the whole bundle.
