Should a family gift be completed before E-2 preparation?

THE DIRECT ANSWER

Review the intended arrangement and available source evidence early, before relying on the money in a filing or commercial commitment. The eventual record must accurately show investor possession, control and qualifying investment.

Coordinate documentation with the transaction

Collect donor records while they remain accessible and record each transfer as it happens. If the arrangement changes from gift to loan or equity, update the ownership and funding analysis before submission. Government processing does not cure an incomplete transfer history.

Keep business deadlines realistic until the funding, commitment and operating evidence are sufficiently developed for the selected application route. Coordinate the documentation with the transaction rather than completing the transfer and reconstructing the explanation afterwards. In practice this means establishing what the donor can evidence before the money moves, since a gift made from an account whose history cannot be documented creates a problem that the transfer itself cannot solve.

Where the donor's records will take time to assemble, that work sets the schedule. Once the position is understood, the transfer can be made and documented cleanly in a single step, with the instrument, the debit and the credit all dated and consistent. Avoid a sequence in which funds move informally, are used, and are then characterized as a gift after the fact, since that produces a file in which the most important step is the least evidenced.
