THE SHORT ANSWER

The best-supported principal may differ between L-1 and E-2. One spouse may have qualifying foreign employment while the other owns or controls the investment. Compare each person’s actual evidence and intended work before choosing a principal; marriage does not transfer employment history, capital ownership or managerial qualifications between spouses. The first comparison should produce two separate evidence files and a reasoned choice of principal, not a blended account of a married couple’s assets. For L-1, the proposed transferee needs one continuous year of qualifying employment with the related overseas organization in the prior three years; overall L-1A and L-1B time limits differ. For E-2, capital must be committed beyond revocation and exposed to loss, the enterprise cannot be marginal, and the investor must direct and develop it. Neither route automatically promises permanent residence.

01

Prepare two individual fact sheets

For each spouse, record nationality, foreign employment, duties, ownership and intended U.S. role. L-1 eligibility belongs to the proposed transferee, so one spouse’s qualifying year does not establish the other’s. Review executive, managerial or specialized-knowledge capacity using actual work records. Do not select a principal solely because that person has a convenient travel history or more available time. Use employment records, organization charts, and ownership documents to assess the L option for the person who would transfer. The decision is whether that individual has a qualifying corporate role, rather than whether the other spouse has funds available.

02

Trace investor rights and money

For E-2, identify who possesses and controls the qualifying funds and who will develop and direct the enterprise. Joint savings or shared ownership require an accurate explanation, not an assumption that either spouse may claim every fact identically. Counsel should review any gift, ownership or governance arrangement on its substance before treating a change in principal as a simple form edit. Trace the E-2 money from its source to executed business commitments and compare it with the governance rights. The decision is whether the investor truly has both the risk-bearing capital and the power to run the venture, not which spouse has the more convenient passport.

03

Connect the choice to real family plans

Once a principal route is supported, assess the other spouse’s derivative status and employment evidence separately. Qualifying spouse work rights do not cure a weak principal case. Keep children’s eligibility and individual deadlines visible. The comparison may support one principal more clearly, but it should not manufacture a role or transfer of funds merely to produce that preference. Hypothetical example: one spouse owns a remote-sensing software firm and has worked there abroad for years; the other spouse holds the funds for a new geothermal-monitoring business. They must decide whether the corporate transfer evidence or the investment evidence is more complete for the chosen principal. Moving assets or titles solely to imitate the other route can create a new proof problem.
