Are foreign operating expenses part of the L-1A application fee?

THE DIRECT ANSWER

No. Keeping a real foreign business operating involves commercial expenses separate from immigration filing and professional charges. Paying registration renewals alone does not demonstrate the business activity required for L classification.

Budget for continuity

Account for the people, services and infrastructure the foreign operation actually needs after the transfer. Separately obtain a current quote for the petition, family procedures and any legal analysis of restructuring. Do not confuse those expenses with a mandated L-1A investment amount.

If management expects the foreign operation to shrink or consolidate, include the cost of assessing the revised structure before committing to the change. Operating expenses abroad are business costs and form no part of any filing fee; the two are frequently conflated in founder budgeting. What the immigration process does add is the cost of evidencing continuity, which recurs rather than being incurred once.

Budget for the periodic assembly of the operating record, any accounting or bookkeeping support needed to produce clean statements in two jurisdictions, and translations where records are not in English. Then budget separately for keeping the foreign business genuinely operating, including whatever a handover manager costs, since that is what the continuity depends on. Verify government charges against the actual petitioner and filing type including any applicable supplemental fee.

A well-documented record cannot compensate for an operation that has in fact ceased.
