Should family travel depend on the escrow release date?

THE DIRECT ANSWER

The release date is a commercial milestone, not confirmation of every family member’s immigration position. A spouse and unmarried children under 21 need their own dependent process and admission records.

Coordinate the move with actual documents

A spouse in valid E-2 or E-2S status is generally work authorized incident to status; children are not. Plan employment and school arrangements around the family’s actual permissions rather than an anticipated closing. If dependants travel later, verify their individual requirements and admitted stays.

Escrow terms cannot promise visa issuance, family admission or the date a spouse may begin work. Avoid tying family travel to an escrow release date, since release depends on a condition whose timing is not within the household's control and may not resolve as expected. Coordinate the move with documents that actually exist rather than with a projected event.

Establish what each family member's position would be if the condition is delayed, and keep arrangements reversible until the position is settled. Any work authorization available to a spouse depends on holding and maintaining valid dependent status; children may accompany as dependants while unmarried and under 21 and do not receive work authorization through that status. Where schooling or a partner's employment requires a fixed date, identify that constraint early so that the transaction can be structured with it in mind rather than colliding with it later.
